Should a user accept an invitation from a family member or a third party clinician or therapist to participate in GuardiAnn Service, parents, guardians, or clinicians may have access to specific information via the Family Board in the GuardiAnn Service or other commensurate services, including but not limited to email address, secret identity, and avatar. For challenges solely hosted by them, they may view details such as successful days, completed challenges, and skill badges earned. To preserve user privacy, hosts are not privy to any notes made within the app, custom activities, or information unrelated to hosted challenges.

Information Disclosure by GuardiAnn

GuardiAnn may disclose user information under the following circumstances:
  1. With User Consent: Personal information will be shared with external parties when consent has been obtained from the user.
  2. For External Processing: GuardiAnn may provide both personal and non-personal information to trusted partners, vendors, and affiliated organizations for processing purposes, in accordance with our Privacy Notice and necessary confidentiality and security protocols.

Usr Rights and Choices Regarding Information Use Promoional Communications

Users may receive promotional communications from GuardiAnn following initial interaction with the Service or upon request. Users have the right to opt out of promotional communications during data collection or subsequently by following the instructions provided. Opting out may affect service use, but non-promotional communications will still be sent regarding account matters or ongoing business relations. Upon account creation, users may opt to receive periodic newsletters with updates and information. Account Management

Users retain control over the information provided to GuardiAnn and may review, edit, or delete any submitted information by accessing their account. However, deletion may hinder the ability to effectively utilize the Service. Users may aso delete their accounts, which will result in the removal of account history and related activities in line with data retention practices.

Rights of EU Resident

GuardiAnn processes personal data only under lawful bases, including fulfilling service delivery obligations, obtaining user consent, compliance with legal mandates, or pursuing legitimate interests while considering privacy rights. Users within the EU possess rights under the General Data Protection Regulation, including access to, updating, and deletion of personal data, objection to specific processing, or filing complaints with supervisory authorities. The easiest method for users to remove all personal data is via the account deletion function.

Rights of California and Nevada Residents

California residents (excluding job applicants and employees) have the right to request information regarding the collection, use, and disclosure of their personal data. Additionally, they may request deletion of their information, typically accomplished through account settings. Requests made via support will necessitate verification of account ownership.
Under California law, we are obligated to disclose whether we "sell" personal information as defined by applicable legislation. Based on our understanding, we do not engage in the sale of personal information. We also maintain compliance with Nevada regulations and do not exchange personal data for monetary compensation. The personal information of minors under 16 is not sold.

Data Retention Policy

GuardiAnn retains personal information for as long as user accounts are active or as required to fulfill legitimate business purposes and legal obligations. Upon cessation of these conditions, information is removed according to standard deletion protocols. Non-personal information, including de-identified or aggregated data, may be retained indefinitely.
Records of support interactions and communications will be retained indefinitely to enhance support processes and maintain accurate business records.

By accessing or utilizing any portion of the Service, you affirm that you have read, understood, and agreed to be bound by this Privacy Policy, including any future modifications. GuardiAnn reserves the right to amend, update, or modify this Privacy Policy. Users will be notified of such changes via a notice on the GuardiAnn website for a minimum of 7 days following any revisions. Revisions will take effect at the end of the aforementioned 7-day period or upon the user's first access or use of the Service post-modification. If you do not agree to the terms of the Privacy Policy, you are not authorized to use, access, or participate in the Service.
